Terms of Business
Terms of Business: version 10.00 (16/12/21)
PLEASE NOTE THAT, DUE TO THE COVID-19 CRISIS, ALL MY WORK IS CARRIED OUT ONLINE UNTIL FURTHER NOTICE
1. General
1a) The ToB applicable
# The version of the Terms of Business – see above – applicable is the one current at the time of contractual agreement.
1b) Variation of Rights
# I reserve the right to vary the ToB applicable in your favour at my discretion. Any such variation does not set a precedent in our arrangements, current or future, and does not affect any of my other rights not included in such a variation.
# Your statutory rights under United Kingdom and European Union laws are preserved under all contractual arrangements.
2. Workshop Programmes hosted by myself.
2a) Payments via PayPal
# Your payment will be credited immediately and Receipt/Invoice, Joining Instructions, Map/Directions and any advance reading materials will be mailed 1st class within 2-3 days and you should receive the package within 5 working days. If you are an overseas customer, please allow at least 14 days to receive this package. Please contact me if you do not receive your package within the indicated time period.
2b) Reservations & Payments via cheque or international money order – individuals, UK & overseas organisations
# Should you choose to reserve a place/places and send payment (cheque or international money order) by mail, I will advise by phone or email within 24 hours if your reservation requirements can be met. If they can, you should send payment immediately. I will confirm receipt by phone or email. Your Receipt/Invoice, Joining Instructions, Map/Directions and any advance reading materials will be mailed 1st class within 2-3 days and you should receive the package within 5 working days. Please allow at least 14 days if you are an overseas customer.
# Reservations will only be confirmed when payment has cleared my bank. (Until then they are only tentative.) Please ensure you allow sufficient time for this if you choose to pay this way.
# Cheques and international money orders should be in £ sterling and must be contain full payment. Please make payment to ‘Keith E Rice’.
2c) Reservations & Payments via cheque, BACS or PayPal – credit for UK organisations
# UK organisations with a satisfactory credit rating may request to be invoiced when making a reservation. I will advise by phone or email within 24 hours if your reservation requirements can be met. If they can, I will issue an Invoice to accompany Joining Instructions, Map/Directions and any advance reading materials. These will be mailed 1st class within 2-3 days and you should receive the package within 5 working days. Terms of payment: 30 days from date of invoice. Cheques should be made payable to ‘Keith E Rice’. Bank account details for transfer are included on the Invoice. If you would prefer to pay by PayPal, please get in touch via the Contact page to discuss this.
# Please note I reserve the right to charge for late payment – see 9 below.
2d) Discounts
# I sometimes apply discounts for multi-place bookings – eg: for all places from the 4th one on. Please check the specific details of the course you are interested in before booking or reserving.
3e) Cancellations & Refunds
# If, for any reason, I am unable to run a programme, all payments taken will be refunded in full.
# If you, as a participant, withdraw from a programme within a week of its start date, your payment will be non-refundable. If you withdraw within a fortnight but more than a week from the start date, a quarter of your payment will be refunded. If you withdraw from a programme 2-3 weeks from its start date, a half of your payment will be refunded. If you withdraw 3-4 weeks from the start date, three-quarters of your payment will be refunded. If you withdraw from the programme no less than 4 weeks from the start date, your payment will be refunded in full. (I may vary these conditions to the withdrawing participant’s benefit, depending on the circumstances of the withdrawal. See 1b above)
3. Workshop Programmes & Other Events led by myself but hosted by 3rd Parties
# Your contractual arrangement is with the 3rd Party.
# You are invited to discuss any matter to do with delivery of my content with me.
# All financial and logistical queries should be directed to the hosting 3rd Party.
4. Tuition for Individuals
4a) Programme of Work
# The Programme of Work will be as agreed between the tutee, the person paying for the tuition (if not the tutee) and I and documented as a de facto contract in at least email format. Any extensions or supplementation of the programme will be as agreed between us and documented in at least email format.
# The contract is between myself and the person paying on behalf of the tutee. As this is usually a parent, I prefer the contracting parent to be involved in drawing up the Programme of Work and playing at least a consultative role in any amendments to the programme.
# My standard hourly rate is £25. Where 2 students wish to be tutored together, a discount can be applied to reduce the charge per student to £20 each.
# The tutee, should attend sessions promptly and be equipped to learn (pen, writing pad, text book, etc).
# Most tuition programmes will involve assignments in between at least some of the sessions. The tutee, must endeavour to complete all assignments in the agreed timeframe.
# Progress reports (how ever brief) and any concerns will be provided to the contracting parent as appropriate. Where the tutee is paying themselves, discussion on progress and concerns will take place as an adjunct to the tuition session.
# If I feel that either my style does not suit the tutee or the tutee is not making progress, at my discretion, after consultation with the contracting person (parent or tutee), I will recommend the tutee seeks tuition elsewhere and will endeavour to help you find that tuition (within reason). The tutee or contracting parent may, any time, terminate the arrangement, subject to their account being up to date.
4b) Travel to Your Premises
# I vastly prefer to conduct tuition from my own home office – for access to my resources. However, if necessary, I will travel to the tutee’s premises if in the immediate Shipley/Bradford/east Leeds area. To cover my time and costs, I charge a fee of £3.50 to cover each quarter hour of travelling time there and back, plus mileage at a rate of 45p there and back.
# If you wish me to come to your premises beyond the immediate Shipley/Bradford/east Leeds area, then please get in touch via the Contact page to discuss this.
4c) Payment & Missed Sessions
# Payment will be required at the end of each session – either as cash, cheque or immediate bank transfer – unless explicitly agreed in advance with myself and documented in at least email format. Cheques should be made payable to ‘Keith E Rice’.
# Should the tutee need to cancel or reschedule a session, failure to inform me at least 12 hours in advance will render the tutee or contracting parent liable to a cancellation fee of £12.50. Subject to the tutee having mitigating circumstances, I reserve the right to waive the cancellation fee at my discretion and without prejudice to my rights.
# Should the tutee be sufficiently under the influence of alcohol or non-prescribed drugs to render a session pointless or dangerous, then the session will be cancelled and a cancellation fee of £12.50 incurred.
# Should the tutee terminate a programme owing monies, the tutee or the contracting parent as appropriate will be invoiced for the outstanding amount, with 5 days from date of invoice to pay.
# Please note I reserve the right to charge for late payment – see 7 below.
# Please note that, in the event of the tutee or contracting parent failing to pay the full amount at the end of a session, I reserve the right to insist on receiving payment at the beginning of future sessions.
5. PDF Downloads from www.integratedsociopsychology.net
I may, from time to time, make certain PDF downloads available free of charge for a period of time. Such downloads are subject to the following Rights & Restrictions:-
# Downloaded PDFs are for the non-commercial and private use of the person doing the downloading. (That private use can be considered to include sharing with close family and friends.)
# Downloaded PDFs must not be distributed electronically – except with my documented permission in at least email format.
6. Late Payments
# I reserve the right to charge interest on late payments in accordance with the Late Payment of Commercial Debts (Interest) Act 1998 as amended and supplemented by the Late Payment of Commercial Debts Regulations 2002.
# As allowed by legislation, interest will be charged at the Bank of England reference rate plus 8%.
# Any concession on my part with regard to not charging interest on overdue accounts is without prejudice and does not set a precedent for any other dealings, current or future.
7. My Obligations to the Client
# To carry out the work to the best of my professional abilities and in your interests.
# To keep the customer fully advised of progress and make the customer aware at the earliest opportunity of any obstacles to achieving the agreed objectives.
# All information supplied to be, to the best of my knowledge, current and accurate – see point 8).
8. Accuracy of Information Provided
Whilst it is crucially important to me to provide the most accurate and most up-t0-date research concerning and all information related to topics covered/discussed on this website and with clients online or in person, no absolute guarantee of current validity of such information is offered. Research is ongoing and continuous and may at any time produce findings and conclusions which seem at odds with my current understanding.
9. Dissatisfactions & Disputes
# In the event of any unhappiness with my work or products supplied by me, please do approach me to discuss the matter.
# In the unlikely event that we are unable to resolve a dispute between us, the consumer laws and other relevant legislation of England and the judgements of the English courts shall apply in the first instance.
# In the event that the customer believes I have behaved unethically and/or unprofessionally, the customer may have additional means of redress through the following professional bodies whose codes of conduct I am committed to complying with…

10. Testimonials & Case Studies
# My work is highly successful and many of my clients/customers are only too happy to provide me with testimonials and/or case studies. I may ask you, as a client/customer, to agree to such. You have no obligation to say ‘Yes’ and any refusal will have no detrimental effect on our relations.
# If you agree to a testimonial and/or case study, you will have the final say on what does/doesn’t appear.
